These terms of service apply to the use of the Discord bot and web dashboard "Brigarde Killfeed" (the "Service"), operated by Deacon Härschel. By ticking the box when setting up your Discord server, you expressly accept these terms of service and the Data Processing Agreement (DPA) before the Service processes your data.
The usage agreement is formed once you log in via Discord, select a Discord server, and expressly accept these terms of service together with the DPA.
Use of the Service is reserved for persons aged 18 and over. By using the Service, you confirm that you are at least 18 years old.
The Service connects a Nitrado DayZ server you provide with Discord and a web dashboard, including kill feeds, statistics, settings, and automated tasks.
By connecting a Nitrado server, you confirm that you are the owner or a Nitrado -authorised administrator of that server and are authorised to share its credentials and server logs with this Service.
The Service may only be used within the bounds of Nitrado's and Discord's own terms of service and applicable law. In particular, the following are prohibited: accessing servers or Discord accounts of third parties without their consent, attempting to circumvent the Service's security, and using the Service to distribute unlawful content.
The Service is operated to the best of our knowledge, but there is no entitlement to uninterrupted availability. Maintenance, outages at third-party providers (Discord, Nitrado, hosting), or technical faults may temporarily limit use.
You provide your own Nitrado access for using the Service and are responsible for the security of your own credentials. Automated features (e.g. scheduled tasks) modify configuration files on your server; back up any important configuration of your own before enabling such features.
Use of the Service is currently free of charge. Any donations are made voluntarily and without entitlement to a specific consideration, unless expressly agreed otherwise.
I am liable without limitation for intent and gross negligence, and for damages arising from injury to life, body, or health. For slightly negligent breaches of material contractual obligations (obligations whose fulfilment enables proper use of the Service in the first place, and on whose observance you may regularly rely), liability is limited to the foreseeable damage typical for this type of contract at the time the contract was formed. Otherwise, liability for slight negligence is excluded. I am only liable for data loss to the extent the damage could not have been avoided by reasonable data backups of your own (see item 8).
In case of misuse, violations of these terms, or violations of applicable law, I may restrict or suspend access to the Service – immediately for serious violations, otherwise with reasonable prior notice. Suspension ends future processing of your server data; data already stored is handled according to the periods stated in the privacy policy.
You may stop using the Service at any time by disconnecting your server access in the dashboard or by asking me to do so by email.
These terms of service may be adjusted as needed, e.g. when the scope of the Service changes. I will show you material changes in the dashboard at least 14 days before they take effect; if you continue to use the Service afterwards, this counts as acceptance, provided I have informed you beforehand. Mandatory consumer-protection provisions of your habitual country of residence remain unaffected by this clause.
This Service is an independent, private project and is not affiliated with, sponsored by, or authorised by Discord Inc., Nitrado GmbH, Bohemia Interactive a.s., or the DayZ brand. All trademarks mentioned belong to their respective owners.
German law applies. These terms of service apply together with the Data Processing Agreement (DPA), available via the dashboard footer.
